These Terms of Use govern your use of the Safety First Training website and, where applicable, your booking and enrolment in our courses.
By using this website, submitting a booking or enrolment, or participating in a course, you agree to comply with these Terms and any applicable enrolment terms, policies and procedures provided to you.

2. Use of this website
You may use this website for lawful purposes only.
You must not:
use the website for an unlawful or fraudulent purpose;
interfere with or disrupt the operation or security of the website;
attempt to gain unauthorised access to our systems or information;
copy, reproduce or misuse website content without permission; or
use the website in a way that could damage or interfere with our services or other users.
We may update, change, suspend or withdraw website content or functionality from time to time.
3. Course information
We take reasonable care to ensure that course information published on our website is accurate and current. This may include course descriptions, dates, locations, prices, prerequisites and availability.
Course information may change from time to time. Course places are subject to availability and applicable enrolment requirements.
Where an error is identified, we may correct the information. A course, course date or advertised price may also be changed or withdrawn where permitted by law.
4. Bookings and enrollments
Submitting a booking or enrolment request does not necessarily guarantee a place in a course.
A place is confirmed when Safety First Training has accepted the enrolment and any required payment or deposit has been received.
You are responsible for providing accurate and complete information during the booking and enrolment process, including any information required for VET registration, identification, USI verification or certification.
Some courses may have prerequisites, entry requirements, identification requirements, language, literacy, numeracy or digital requirements, or other conditions that must be satisfied before or during training.
5. Fees and payments
Course fees, deposits and other applicable charges will be provided before enrolment.
Safety First Training will not require or collect more than $1,500 per individual student prior to course commencement, unless the total course fee is less than $1,500, in which case the full course fee may be payable before commencement.
Where applicable, remaining fees will be payable in accordance with the payment arrangements provided to you.
Payment processing may be provided by third-party payment providers.
6. Cancellation, transfers and refunds
Cancellation, transfer and refund arrangements are provided to students before enrolment and form part of the applicable enrolment terms.
Unless otherwise stated in the applicable course information or enrolment agreement:
cancellation requests should be made in writing;
cancellations received 7 days or more before course commencement may receive a refund less any applicable non-refundable enrolment/administration fee;
cancellations received less than 7 days before course commencement may not be eligible for a refund;
requests relating to exceptional or unforeseen circumstances may be considered in accordance with Safety First Training’s refund policy; and
where Safety First Training cancels a course or fails to provide the agreed services, applicable refund or alternative arrangements will be provided in accordance with the law and our refund policy.
Nothing in these Terms limits any refund, consumer guarantee or other right that cannot lawfully be excluded.
The applicable Student Handbook and enrolment terms contain further information about fees, refunds, transfers and fee protection.
7. Attendance, assessment and certification
Students must attend and participate in the required training and complete all required assessment activities.
Certification is issued where a student has successfully completed the relevant training and assessment requirements and has satisfied any applicable certification requirements.
Statements of Attainment are issued for units of competency in which the student has been assessed as competent.
Where a student is assessed as not yet competent, applicable reassessment opportunities will be provided in accordance with Safety First Training’s assessment and reassessment procedures.
8. Credit transfer and recognition
Safety First Training recognises applicable Australian Qualifications Framework (AQF) qualifications and Statements of Attainment issued by other Registered Training Organisations.
Students may apply for Credit Transfer where previously completed units meet the applicable requirements. Evidence of previous achievement may be required.

9. Student support and LLND
Safety First Training aims to provide an inclusive learning environment and appropriate support to students.
Students may discuss their learning, language, literacy, numeracy or digital support needs with our staff or trainers.
Where appropriate, Safety First Training may provide support directly or refer students to suitable external support services.
Students should notify Safety First Training of any relevant support needs as early as possible so that appropriate arrangements can be considered.
10. Student conduct and safety
Students must:
follow reasonable instructions from trainers and staff;
comply with applicable health and safety requirements;
participate appropriately in practical training and assessment;
treat staff, trainers and other students respectfully; and
comply with applicable Safety First Training policies and procedures.
Safety First Training may take appropriate action where a student’s behaviour creates a safety risk, significantly disrupts training, or breaches applicable policies or requirements.
Any action taken will be subject to applicable law and Safety First Training’s policies and procedures.
11. Complaints and appeals
Students have the right to access Safety First Training’s complaints and appeals processes.
Complaints and appeals can be made in accordance with the procedures set out in the Student Handbook.
The complaints and appeals process is designed to be accessible, fair, objective and transparent.
Students may raise concerns about matters including training, assessment, services, staff conduct or other aspects of their experience with Safety First Training.
Students may also access relevant external complaint or review mechanisms where applicable.

12. Changes to agreed services
If there is a significant change to an agreed training service that may affect a student, Safety First Training will provide information to affected students as soon as reasonably practicable.
This may include changes to course arrangements, delivery arrangements, third-party arrangements or other circumstances affecting the provision of training.
Where Safety First Training is unable to provide the agreed services, applicable arrangements will be made in accordance with the law and our policies.
13. Intellectual property
Unless otherwise stated, the content of this website, including text, graphics, photographs, logos, documents and other materials, is owned by or licensed to Safety First Training.
You must not reproduce, distribute, modify, publish or commercially use our content without our written permission, except where permitted by law.
Training materials provided to students are supplied for the student’s training and assessment purposes and must not be reproduced or distributed without permission, except where permitted by law.
14. Privacy
Safety First Training handles personal information in accordance with its Privacy Policy.
Our Privacy Policy explains how we collect, use, disclose, store and protect personal information.
Where personal information is collected as part of VET enrolment, additional privacy information may be provided to you as required for the VET sector and government data collection.
15. Consumer rights
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or other applicable legislation where those rights cannot lawfully be excluded, restricted or modified.
To the extent permitted by law, Safety First Training will provide its training and related services with due care and skill and in accordance with applicable consumer guarantees.
16. Website availability
We do not guarantee that the website will always be available, uninterrupted or free from errors.
We may perform maintenance, updates or other changes that temporarily affect website availability.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes to our services, policies, systems or legal and regulatory requirements.
The current version will be published on our website with the date it was last updated.
18. Governing law
These Terms are governed by the laws of New South Wales, Australia.
Any applicable legal proceedings will be subject to the jurisdiction of the courts of New South Wales, subject to any rights you may have under applicable law.
